Job Title:              Special Counsel
Salary Range:      $104,755 - $157,132

Location:              LEGAL

 

Summary: Under general supervision of the President / Chief Executive Officer (CEO), assists the agency in handling legal matters referred to Special Counsel by the President / Chief Executive Officer including without limitation, drafting and monitoring complex contracts, assist with the negotiation and documentation of real estate development and acquisition transactions, and other in-house litigation matters as determined by the CEO.

  • Provides legal advice and assists with all aspects of DHA’s real estate transactions, including but not limited to the disposition, development and acquisition of public and affordable housing;
  • Provides legal advice and assists DHA in negotiating construction contracts and other related documents;
  • Drafts complex contracts and other legal documents;
  • Assists the General Counsel and Office of General Counsel in preparation for hearings and trials;
  • Assists the General Counsel in monitoring administrative cases, including resident and employee grievances, EEOC matters and like issue;
  • Provides guidance and collaboration with the President / CEO and key leadership on matters pertaining to government relations and the impact of relevant legislative matters;
  • Conducts research on legislative and other issues impacting the affordable housing industry; recommends DHA’s responses by developing and implementing appropriate initiatives to address such issues;
  • Monitors federal and local regulations and policies that have potential impact on the affordable housing industry and DHA, in particular; advising the President/CEO (Executive Director) and key management staff of such potential impact and organizing an action plan, if deemed necessary;
  • Researches legal issues and prepares memoranda of law, legal briefs, and legal opinions as assigned;
  • Assures absolute confidentiality of work-related issues, client records, and DHA information;
  • Enthusiastically promotes the President / CEO’s priorities for the operations of the DHA.
  • Performs other duties as assigned or required.

 

Knowledge and Skills:

 

  • Knowledge of DHA organization, operations, policies and procedures.
  • Knowledge of the Texas criminal and civil statues, rules, administrative orders, policies and procedures, and applicable Federal rules and regulations.
  • Knowledge of Texas judicial procedures and rules of evidence.
  • Knowledge of legal precedents and court decisions impacting public housing issues.
  • Knowledge of the duties, powers, authorities and limitations of a Special Counsel.
  • Knowledge of legal research methods, techniques, sources and databases.
  • Knowledge of legal case management procedures, ethics and techniques.
  • Knowledge of principles of record keeping, case files and records management.
  • Skills in reviewing and assessing legal issues and documents.
  • Skills in reading, interpreting, understanding and applying legal standards and procedures, applicable Federal rules and regulations, and DHA policies and procedures.
  • Skill in researching and identifying precedence in case law.
  • Skill in verbal and written communication, and exercising judgment and discretion in decision making and negotiations.
  • Skill in operation a person computer and utilizing a variety of business software.
  • Still in establishing cooperative working relationships with employees, attorneys, law enforcement agencies, and other participants in the civil justice process.
  • Skill in effective communication.
  • Skill in interacting with people of different social, economic, and ethnic backgrounds.

 

 Physical Demands:

 

Must be able to lift/carry up to 10 pounds.

 

MINIMUM QUALIFICATIONS:

Juris Doctorate (JD) required; and ten (10) years’ experience in the practice of law; civil and real estate law.

Must be licensed by the Supreme Court of Texas to practice law in the State of Texas, remain active with all annual license requirements, and maintain a clear criminal record.
