Tapani is in the construction industry which inherently involves safety risks, including a substantial risk of death. The use of controlled substances, including cannabis use, can heighten safety risks. Further, Tapani works on projects involving federal funds, and is thus subject to the Drug-Free Workplace Act of 1988 for those projects. Both the federal Food and Drug Administration and the Drug Enforcement Agency classify cannabis as a Schedule I controlled substance. Because all employees of Tapani may be present on jobsites from time to time or facilitate administration of projects involving federal funds, in accordance with the exceptions listed in RCW 49.44.240(3)(g), Tapani conducts drug screening, including testing for cannabis usage, as part of its standard pre-hiring process.
